These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and IT Paradise Solutions Sdn. Bhd., the operator of SMS-LAH ("we", "us", "Company"). By creating an account or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By registering for or using SMS-LAH, you represent that (a) you are at least 18 years old, (b) you have the legal authority to enter into this agreement on behalf of yourself or the entity you represent, and (c) you will comply with these Terms and all applicable laws. If you do not agree, you must not use the Service.

2. The Service

SMS-LAH provides a web-based platform and REST API for sending bulk and transactional SMS messages worldwide subject to credit availability and carrier reach. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice where practical, and without liability where legally permissible.

Delivery of SMS is subject to recipient carrier conditions, country regulations, and technical factors beyond our control. We do not guarantee 100% delivery and are not liable for messages that cannot be delivered for reasons outside our reasonable control.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • Provide accurate and complete registration information.
  • Notify us immediately of any unauthorised use of your account at it@mobile360.cc.
  • Not share your login credentials with third parties outside of authorised team members.
  • Ensure all team members added to your account also comply with these Terms.

4. Credits, Pricing & Billing

The Service operates on a credit-based model. Credits must be purchased in advance through our sales team. The following conditions apply:

  • Credits are purchased either by unit quantity (Credit by Unit) or by monetary value in MYR (Cash Reload).
  • All credit purchases are non-refundable once processed, except at our sole discretion in cases of billing error.
  • Credits are valid for 12 months from the date of purchase. Each subsequent top-up extends the validity of your entire outstanding balance for a further 12 months from the top-up date.
  • Credits cannot be transferred between accounts.
  • There is no setup fee. There are no monthly subscription fees. You pay only for credits purchased.
  • We reserve the right to adjust credit rates with 30 days' advance notice. Existing purchased credits will not be repriced retroactively.
  • SMS delivery costs per country are indicative and may vary by carrier. The final credit deduction is displayed at campaign review before you confirm any send.
  • Self-serve online payment is not yet available. Purchases are processed manually through our sales team.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must:

  • Obtain prior, explicit, and documented consent from all SMS recipients before sending any commercial or promotional messages as required by applicable law.
  • Honour opt-out requests from recipients promptly and maintain an accurate suppression list.
  • Ensure all messages comply with the laws and regulations of the destination country, including local telecommunications regulations and do-not-call registries.
  • Not impersonate any person, business, or government entity.
  • Use the platform only for legitimate business communication purposes.

6. Prohibited Content

The following content is strictly prohibited on SMS-LAH:

  • Phishing, fraud, scams, or any deceptive practices.
  • Unsolicited bulk messaging (spam) to recipients who have not consented.
  • Content that is defamatory, obscene, harassing, or threatening.
  • Messages promoting illegal products, services, or activities.
  • Content that violates the intellectual property rights of any party.
  • Messages related to unlicensed financial services, gambling, or adult content not permitted by local law.
  • Any content that violates carrier guidelines or industry codes of practice.

We reserve the right to immediately suspend accounts found sending prohibited content, forfeit unused credits, and report violations to the relevant authorities.

7. Intellectual Property

The SMS-LAH platform, including its design, software, logos, and content created by us, is owned by IT Paradise Solutions Sdn. Bhd. and protected by Malaysian and international intellectual property law. These Terms do not grant you any rights to our intellectual property.

You retain all rights to the content you create and the contact data you upload. By using the Service, you grant us a limited licence to process that content solely to deliver the Service.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law, SMS-LAH and IT Paradise Solutions Sdn. Bhd. shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages arising from your use of the Service.
  • Loss of data, revenue, or business opportunities caused by Service outages or delivery failures.
  • Actions taken by third-party carriers, regulators, or other parties outside our control.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Mobile360 Sdn Bhd, its directors, employees, and agents from and against any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

10. Termination

We may suspend or terminate your account without prior notice if you breach these Terms, engage in fraudulent activity, or use the Service in a manner that may expose us or others to legal liability. Upon termination:

  • All pending campaigns will be stopped.
  • Remaining credits will be forfeited and are non-refundable, unless termination was caused by our error.
  • You may request export of your contact data within 30 days of termination.

You may also terminate your account at any time by contacting us at it@mobile360.cc. Unused credits at voluntary termination are non-refundable.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email to registered account holders or by posting a notice in the platform. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
